WSRC Delinquent - $300,000.00 Electric Bill (new post)

    Does the WSRC lose their deposit when the electric is turned off?

    The electric company knows the State is having financial problems, the State realizes they just do not go away and you can only tax people to a point, the WSRC/IDNR has to know and realize there is an outstanding bill that is well past due and not going to go away, the ATA is not responsible for this unless they accept the responsibility and pay it ( seriously doubt that, I hope ) so they facility can be operational at the times when they need it to be ... Nothing is being said other than they (the ATA ) are under the impression they are going to resume as if nothing ever happen and the lease was not defaulted on by the State ... The shoots being on any schedule means nothing as that can change in a heart beat as it has in the past ... The ATA failing to say anything speaks volumes in a way, and the transparency continues like looking through smoke and mirrors ... Hope it works out for all those (few) who are planning on attending, but based on all of the hocus pokus, I have my doubts ... WPT ... (YAC) ...

    If I am reading this right these charges are for the month of March ($20,526.79 - 03-01-16/ 04-01-16), judging by the amount of KWH in July, August, September which appear to be double that amount plus if the ATA takes control they will be responsible for 4 x's (PLUS) that amount just for the dates they are supposed to use or control the facility ... This could get ugly folks ... WPT ... (YAC) ...

    WPT IDNR is responsible for those electric bills, that was why there was a lease If I am not mistaken. Did the lease specify that the ATA pay the electric bills, I did not see that entry. The Electric company did not bill the ATA, if I read the bill correctly.

    How can any business still have electricity when their Bill is a Year past due. If that were you or I the electric would be turned off at 60 days past due.

    This absolutely should be a burden on Ruaral Electric Companies like Egyption Electric Cooperative.

    Doc,

    Egyptian Electric Cooperative Association is not in business to make a profit. In fact, their by-laws specifically state that they are to function as a "non-profit" organization.

    "Egyptian Electric Cooperative Association is a not-for-profit service cooperative owned by those who receive our services (called member-owners). We are governed by a nine-person board elected from among the member-owners. Board members hold three-year terms, with three directors elected each year at an annual meeting."

    "From 1940, when 224 members on a 95-mile-long line in Jackson and Randolph counties were the first to receive power from the cooperative, Egyptian Electric Cooperative has been an important part of the economic and social development of the region. Today, with headquarters in Steeleville and a district office in Murphysboro, we provide electric service to more than 17,000 meters over a distribution network of over 2,300 miles of line."

    The IDNR is a member of the EECA, and as such submitted a membership application just as every household who receives their electric had to do.

    SECTION 7.03. Members' and Non-Members' Responsibilities. The members of the Cooperative, by dealing with the Cooperative, acknowledge that the terms and provisions of the Articles of Incorporation and By-laws shall constitute and be a contract between the Cooperative and each member, and both the Cooperative and the members are bound by such contract, as fully as though each member had individually signed a separate instrument containing such terms and provisions. The provisions of this Article of the By-laws shall be called to the attention of each member of the Cooperative by posting in a conspicuous place in the Cooperative's offices.

    Therefore : "Each member shall also pay all amounts owed by him to the Cooperative as and when they become due and payable."


    In essence, the IDNR has not complied with their agreement with the Egyptian Electric Cooperation Association just as they failed to live up to their agreement with the ATA. I suspect both Associations will not hold the IDNR to their commitment.

    The larger question in my mind deals with the fairness to the membership. The IDNR's irresponsible actions has caused major problems for the ATA and it's members. Likewise, what action will the Egyptian Electric's Board of Directors take to insure the successful operation of the Co-Op and how unfair that member households pay their monthly electric bill when the IDNR doesn't even make a monthly partial payment.

    I wonder if the EECA BOD has complied with this by-law ? :

    SECTION 2.01. Termination of Membership. Memberships may be terminated as follows:

    (a) Any member may withdraw from membership upon compliance with such uniform terms and conditions as the Board may prescribe. The Board may, by the affirmative vote of not less than 2/3 of all the members of the Board, expel any member who fails to comply with any of the provisions of the Articles of Incorporation, By-Laws or rules or regulations adopted by the Board, but only if such member shall have been given written notice by the Cooperative that such failure makes such member liable to expulsion and such failure shall have continued for at least 10 days after such notice was given.

    On a final note, the EECA webpage says the association of Co-ops bought into a coal powered operation in 2006 :


    "To ensure cooperative Members have a reliable source of electric energy for years to come, Southern Illinois Power Cooperative purchased a portion of the new Prairie State Energy Campus (PSEC) near Marissa, Ill., in 2006.
    PSEC is a state of the art coal-fired power plant that came on-line in 2012 and uses the newest technology to ensure the plant is a good environmental steward. The plant was even located across the road from the coal mine that provides the coal to eliminate all transportation costs and environmental impacts."

    I guess they were not aware that there's a certain political party trying to put the coal industry and mine workers out of business . . . . permanently !

    Although Egyptian power may be a non-profit or a not for profit, I suspect the people in charge of the corporation must act in the best interest of the corporation. I suspect they are required to hold their feet to the fire.

    Thank you for posting that as it is a very interesting read, that's for sure ...

    It appears that "acting in the best interest" of the corporation or association is subjective at best on more than one account at this present time and before now by about 15 years on one account ...

    The area in and around Sparta is coal country, hence Peabody Coal having once owned the property the WSRC sits on and it being strip mined ... Can't help but wonder why the Co Op has not acted in the best interest of the other members ..? The ATA also for that matter ... WPT ... (YAC) ...

    The terms of the lease (original and extension) included all of the extra's (utilities) to make it and keep it operational ... Those terms obviously are not going to make the State of Illinois any money or even allow for them to break even, so they will probably (tentatively, possibly, etc, etc .) have to be changed, altered, or modified to correct that little problem ... The ATA has made money while the State was going in the hole and they finally recognized it and creased operations at the facility ... That bill reflects something was going on at the facility to generate a bill for electric usage in what would probably be considered to be off season (?) , 20 K for one month is a lot of electric to use if nothing is happening ...
    The way the EECA has grown gives one the impression they know what they are doing which would be out of character given these circumstances making it a messy situation for them to be in from a business stand point ... I can't imagine them (EECA) supplying service much into the future if nothing is done to correct the situation, once the board get wind of this some proverbial chit will probably (possibly, tentatively,more than likely ) hit the fan, no MOU about it ... WPT ... (YAC) ...

    Perhaps it wasn't intended to be, but it looks like the State is making sure it is. ;)

    Yep, fairness to all those other members would be first on my mind.

    Like a lot of taxpayers, we make up for the others who skirt the system.

    The ATA is a not for profit Corp also, (501-C-3) they make money on each and every registered shoot plus dividends or they would not have over $13 million dollars on hand or invested ... The problem is the EC and or some of the BOD think that is their petty cash and they can use it at will ... I talked to someone who is involved to a degree in politics, says the State has no intention of honoring the lease as it was written and or amended to ... I guess we will see .... WPT ...     I would think the powers that be in the ATA would want a confirmed clarification on the lease pretty soon.

    Is the State thinking the same way they are ? Too many questions left to assumption.

    The so called negotiations would of been the time to confirm any and all modifications to the lease as its written ... The State of Illinois cannot afford to lease the facility under the old conditions and continue to add to the State financial crisis and deficit which has been grossly understated and underestimated by the States comptroller according to their web site ... There may be some surprises in store for all involved once it all comes out, then if its made public for every ones viewing pleasure ... The ATA claims to have Co Sponsors lined up according to the ATA web site and face book pages, but nothing is being said about to what extent they are paying for the Co sponsorship ... It appears there is more "Smoke and mirrors" coming for all to not see or so the members don't know what is going on ... The Politico's of the State (democrats as well as Republican's) are grossly upset over the States involvement in the facility let alone it adding to the deficit on an annual basis as it has since it opened 11 years ago ... The States voters are not happy about tax increases and or under handed actions that are costing the residents like no renewals for licenses for the vehicles and then heavy fines for not getting them in on time ... Looks like Politic as usual both in the State of Illinois and on behalf of the ATA ... Deception, greed, lacking of Integrity and honor seems to be abound these days ... WPT ... (YAC) ...

    The WSRC calendar of events is showing the facility has 63 days spoken for taking all days into consideration till the end of the year ... This is the problem why the facility cannot make money or even break even which would revert back to location, location, location and why they can't draw a crowd, crowd, crowd ... The days accounted for are assuming all of the events take place as per the schedule , not like last year when the place got shuttered with events on the calendar in the "yet to happen" column ... If 63 days are the tally for the year, that means those individual days must each Gross $47,619.00 per day (Based on $3 million annually) to break even plus the offset for cost of living raises and increases in supplies etc ... Thats a lot of Taco's and a bag of chips Senior ... There is anticipation the State is going to add to the deficit at least one more time before this party is over or so it seems ... Wish them luck and well and all that good stuff, but I don't see it happening Grasshopper, nope, nope, nope ain't gonna happen ... WPT ... (YAC) ...

    Remember WPT, us common, every day, annual members, are on a "Need to Know" basis with information provided.

    Pay your dues, daily fees, sit back, and let them spend it without anyone asking any questions.That's what they expect from the members. I always thought it was a member's duty to find out things that were a part of the process.

    Only SOME of the LIFERS, and others who have influence, get the straight dope.

    The days of anyone getting the straight up factual information are and have been long gone for quite awhile , thats primarily the problem that exists and will continue until the EC and BOD are forced to answer to the membership in a reasonable and logical manner ... The separation between the membership, the EC and many of the BOD continues and that in fact creates the suspicions that linger ... The Delegates get elected and forget what they are supposed to do for and with the membership when it comes to the ATA when the time comes ... The EC is a carry over of what the Delegates learn as they progress up the ladder until they are in line for the new gun ... The EC and BOD answer to no one, though they should and they intend to keep it that way and probably will until something of major proportions happens one way or the other .... Thats just the way it is for now any way ... WPT ... (YAC) ...
